Alternatives having been discussed in treaty negotiations we considered that our view could most suitably be placed on record (see paragraph 3 of your telegram No. 1616) in a unilateral note to be addressed to the Minister for Foreign Affairs a few days after signature of treaty. Subject to your approval, text of note will be as follows.
[Begins] XDuring negotiations for treaty and exchange
of notes signed between us on (date) I brought up for discussion the question of protection of persons of dual nationality and I suggested to Your Excellency the inclusion in the exchange of notes of a provision that: "it is understood, in accordance with general international rule with regard to master nationality, that neither High Contracting Party will claim the right to protect persons in territories of the other High Contracting Party who possess nationality of the latter High Contracting Party in addition to the nationality of the former High Contracting Party!!
Your Excellency preferred, however, to postpone further consideration of this matter until another occasion. In accepting this procedure I [gp undee: wish to record the above statement as a principle which, in the view of His Majesty's Government in the United Kingdom should govern the relations of the two Parties in such matters in future.
